Terms of Service

This document was drafted to reflect how the GaveIn app actually works, based on a review of its codebase as of the date above. It has not been reviewed by a lawyer. Have it reviewed by legal counsel — including for a governing-law and dispute-resolution clause appropriate to where you operate — before relying on it for an App Store / Play Store submission or a public launch.

These Terms of Service (“Terms”) govern your use of the GaveIn mobile app (“GaveIn,” the “App,” the “Service”). By creating an account or using the App, you agree to these Terms. If you don’t agree, don’t use the App.

1. What GaveIn is

GaveIn is a social app where you post a photo of yourself facing a moment of temptation, other users make a blind, sealed prediction on whether you’ll resist or give in, and you reveal the actual outcome. The App includes an in-app virtual currency (“flames”) that players can earn from correct predictions and optionally wager on future predictions for a bigger in-app payout.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use GaveIn. By using the App, you represent that you meet this requirement.

3. Your account

You sign in with your email address using a one-time code. You’re responsible for keeping access to that email address secure — anyone who can receive your sign-in code can access your account. You may delete your account at any time from Settings; see our Privacy Policy for what that removes.

4. Content you post

You keep ownership of the photos and captions you post. By posting content to GaveIn, you grant us a license to host, store, display, and distribute that content within the App — to the other players it was posted for, and, once you choose to share a reveal to your Stories, more broadly within the App’s feed — for as long as your account and that content exist.

You agree not to post content that:

• Depicts or involves minors in a sexual or exploitative way, under any circumstance — this is never tolerated and will result in an immediate account ban and, where required, a report to the relevant authorities.
• Is sexually explicit, obscene, or pornographic.
• Depicts, threatens, or promotes violence, self-harm, or illegal acts.
• Harasses, bullies, or targets another person, or contains hate speech directed at a person or group.
• Is spam, or impersonates another person or entity.
• Infringes someone else’s intellectual property or privacy rights.

We may remove content that violates these Terms, and may suspend or terminate accounts responsible for repeated or severe violations, with or without notice.

5. Reporting objectionable content

If you see content that violates these Terms, you can report it directly from the round in question. Reports are reviewed by us; reporting doesn’t notify the person who posted the content, and we don’t disclose who filed a report.

6. Flames (virtual currency)

Flames are a virtual in-app currency with no real-world monetary value. They cannot be purchased with real money, exchanged for cash or any other thing of value, transferred to another player, or redeemed outside the App. Flames are earned entirely through gameplay (correct predictions, including optional wagers on future predictions) and exist solely to track standing within the App — they are not a form of gambling, and no real-money stake is ever placed. We may adjust, reset, or remove flame balances at our discretion, including to correct errors or address abuse of the system.

7. Prohibited use

You agree not to:

• Use the App for any unlawful purpose, or in a way that violates these Terms.
• Attempt to access another user’s account, or interfere with the App’s normal operation (including automated scraping, exploiting bugs, or manipulating votes/wagers/leaderboard standing).
• Reverse engineer, decompile, or attempt to extract the source code of the App, except as permitted by law.

8. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App if you violate these Terms, or at our discretion to protect the App or its users, with or without notice.

9. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, express or implied. We don’t guarantee the App will be uninterrupted, error-free, or available at all times.

10. Limitation of liability

To the fullest extent permitted by law, GaveIn and its developers are not liable for any indirect, incidental, or consequential damages arising from your use of the App.

11. Changes

We may update these Terms or the App over time. If we make material changes to these Terms, we’ll update the date at the top of this page. Continued use of the App after a change means you accept the updated Terms.
